Agreement between Mountain Seekers and the User 

Mountain Seekers and you, the user, have entered into a legally binding agreement (“Agreement”) (“You” or “Your”). Mountain Seekers is made available to you conditioned on your acceptance of the terms, conditions, and notices included herein in its entirety. You affirm your acceptance of, and agreement to be bound by, this Agreement and all such terms, as, and notices by using Mountain Seekers’ Web Site. 

Modification of These Terms of Use 

Mountain seekers reserve the right to amend the terms and conditions of this agreement, including our separate privacy policy, as we deem appropriate from time to time. Such changes, modifications, additions, or deletions will be effective immediately upon posting, unless otherwise specifically indicated. Mountain seekers has no duty or obligation to notify previous users of this website of changes, regardless of the scope and importance of the changes. Usage of Mountain Seekers’ Web site

Send, publish, post, upload, distribute, or disseminate any inappropriate, threatening, abusive, profane, defamatory, infringing, obscene, indecent, or otherwise objectionable materials, or materials that encourage conduct that would constitute a criminal offence, give rise to civil liability, or violate any law, or contain any advertising or solicitation for products or services. Harass, abuse, threaten, or otherwise violate anyone’s legal rights; Attack, criticize, condemn, or impugn a person’s character, or ascribe immoral or dishonourable characteristics to members based on race or ethnicity, gender, age, religion, national origin, handicap, or sexual orientation; Upload viruses, damaged files, or any other software or material that might disrupt the functioning of another person’s computer or network. Use Mountain Seekers’ Web Site for commercial purposes, such as ads, promotions, offers to purchase or sell goods or services, surveys, competitions, pyramid schemes, or sponsorship banners; Infringe on any of Mountain Seekers’ rules, standards, or other codes of behaviour that apply to the Mountain Seekers Web Site or, more specifically, one of Mountain Seekers’ Web Services. Without the explicit written consent of Mountain Seekers, you may not reproduce, re-transmit, or re-present any material, programming code, photos, or graphics in any way, in whole or in part. Mountain seekers do not control or endorse the content, messages, or information found in any of mountain seekers’ web services, and mountain seekers expressly disclaim any liability in relation to mountain seekers’ web services. Mountain seekers do not endorse or verify the accuracy, truthfulness, or reliability of any information provided on its web services unless provided by an authorized mountain seekers spokesperson. Any statements made on mtn seekers’ web services reflect only the views of their authors, and your reliance on such content is at your own risk. 

Product Information and Warranties 

Mountain Seekers advertises and offers third-party services. Unless otherwise specified, the majority of the services mentioned on the site are accessible directly from or via Mountain Seekers Web Site. ALL ITEMS PURCHASED OR SERVICES PROVIDED BY MOUNTAIN SEEKERS ARE MADE IN ACCORDANCE WITH A THIRD PARTY CONTRACT. THIS MEANS THAT THE RISK OF LOSS AND TITLE FOR SUCH ITEMS PASSES TO YOU AFTER WE DELIVER THEM TO THE THIRD PARTY.

Repeat Infringes Policy and Copyright Complaints

Mountain Seekers may further, in its sole discretion, restrict access to the Web Site and/or cancel any account used in conjunction with the violation of any intellectual property rights, whether or not the infringement occurs on a repeated basis.

The Mountain Seekers Web Site may include links to third-party Web Sites. Mountain Seekers has no control over third-party Web Sites, and Mountain Seekers is not responsible for the contents of any third-party Web Sites. Mountain Seekers shall have no responsibility for any element of the service standards offered by the service providers to the extent that it serves simply as a booking agent on behalf of third-party service providers. Mountain Seekers will not be held accountable for the services supplied by the service provider under any circumstances. Indemnity 

YOU AGREE TO INDEMNIFY Mountain Seekers FROM AND AGAINST ANY AND ALL LIABILITIES, EXPENSES (INCLUDING WITHOUT LIMITATION ATTORNEYS’ FEES) AND DAMAGES ARISING OUT OF CLAIMS BASED ON YOUR USE OF Mountain Seekers’ WEBSITE, INCLUDING WITHOUT LIMITATION ANY CLAIM OF LIBEL, DEFAMATION, VIOLATION OF PRIVACY OR PUBLICITY, 

Governing Law 

This Agreement is governed by the laws of the Islamic Republic of Pakistan, and the location of Mountain Seekers’ offices and service providers shall determine jurisdiction if it is international. 

No Relationship 

You agree that as a consequence of this Agreement or use of Mountain Seekers’ Web Site, including, without limitation, Mountain Seekers’ Web Services, no joint venture, partnership, employment, or agency relationship arises between You and Mountain Seekers. 

Construction 

If any part of this Agreement is found to be invalid or unenforceable under applicable law, including, but not limited to, the warranty disclaimers and liability limitations set forth above, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Agreement will remain in effect. 

Entire Agreement 

Unless otherwise specified herein, this Agreement constitutes the entire agreement between You and Mountain Seekers with respect to Mountain Seekers’ Web Site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between You and Mountain Seekers with respect to Mountain Seekers’ Web Site, including, but not limited to, Mountain Seekers’ Web Services. 

Captions and Headings 

Captions and paragraph headers are provided for convenience only and are not part of this Agreement and should not be construed as such. 

Refund and Mode Of Payment to Mountain Seekers 

Mountain Seekers retains the right to take payment solely in the manner specified in this agreement, namely by bank transfers, cash, and credit cards. In the event of a refund, service costs of Rs 1000 will be levied upon receipt of payment from the appropriate third party/supplier/airline after a fourteen-day period. 

Liability On Services 

Mountain Seekers disclaims all liability for any delay, fault, or poor service supplied by third-party contractors listed on Mountain Seekers’ website. Furthermore, Mountain Seekers disclaims all liability for any delays or refusals in the issuing of visas as a result of foreign government policies and their governments. Mountain Seekers shall not be held accountable for the actions of website users or their personal behavior prior to or after the purchase of services from Mountain Seekers’ website.
